A9 : Corporate environmental responsibility: Is it a challenge, a responsibility or a liability?

The ideal of corporate environmental responsibility is for commercial organisations and their people to be more aware of their environmental impact and to be responsible for counteracting their pollution/carbon footprint on global natural resources. This involves what is sometimes a fundamental conflict between protecting the environment and at the same time maintaining economic growth. It need not be thus. We look at the wide picture and how climate change, pandemics, widespread human rights violations, and emerging technologies pose fresh challenges. There have been several agreements internationally to help adopt new business practices that held these standards, but they were considered individual and there was no law-abiding body to regulate nor implement them. How does the legal profession’s pro bono ethic promote the rule of law in climate and environmental litigation. Should CEOs be criminally answerable to the, inter alia, dying orang-utang or the displaced Brazilian forest tribes as a result of their unchecked environmental crimes, both nationally and internationally? On the even wider world stage, should corporations be liable for failing to account for the economic risks of climate change?
