Since before Magna Carta, itinerant courts have been used to preserve public order and spread legal norms. British colonies with far-flung populations have used this approach to bring a justice system to remote communities. In the Canadian Arctic fly-in courts service a mostly-Inuit population of about 40,000 spread across almost 2 million sq. km. But do they provide access to justice? One writer compares these circuit courts to a wheelbarrow being pulled across a field of craggy ice. A former prosecutor says they destroy lives, ignore local culture, and engender inter-ethnic conflict. Would remote communities be better served by a locally-based Justice of the Peace? This session will examine experiences in Commonwealth jurisdictions and look for solutions that truly serve their local populations.
