
Mediation in Ireland: Lawyers, their duties and their attitudes
The Commonwealth Lawyers Association and NIVAARAN – Mediators of the Supreme Court of India present a Guest Lecture on “Mediation in Ireland: lawyers, their duties and their attitudes.” This session will explore the statutory framework governing mediation in Ireland, the professional duties imposed upon lawyers to advise clients on mediation, and the prevailing attitudes within the legal community toward such obligations. Through comparative and research-based insights, the lecture seeks to deepen participants’ understanding of how legislative reform and professional culture together shape the effectiveness of mediation as a dispute resolution mechanism.
The topic probes how lawyers respond to such obligations. Do they meaningfully discharge their duty to advise? Is mediation presented as a genuine dispute resolution pathway, or as a procedural formality to be ticked off before litigation commences? The discussion therefore moves beyond statutory text into professional conduct, ethical responsibility, and institutional mindset.
The lecture will examine the legal architecture established under the Mediation Act 2017, with particular focus on the statutory obligation imposed upon solicitors to advise clients on mediation before initiating proceedings.

Bill Holohan SC offers the lecture as a tribute to his friend His Excellency Akilesh Mishra, the current Indian Ambassador to Ireland, who after 37 years of exemplary service in the Diplomatic Corps of India, will be retiring on Friday 27 February, and who along with his wife Reeti Mishra, will be returning to his native India on 1 March.
